Updates to Legal Terms

Vercel's updated terms clarify who is liable when AI Functionality or connected Third-Party Tools take action on an account, plus new billing and privacy provisions.
Vercel has updated its Terms of Service and Marketplace terms to spell out who is responsible when AI takes action on an account, whether it's Vercel's own AI functionality or a third-party tool a user has connected. The updated terms introduce two categories: "AI Functionality" (Vercel services like v0, Vercel Agent, WAF natural language rules and AI Gateway) and "Third-Party Tools" (any non-Vercel tool, script, service or automation granted access to a Vercel account, AI-powered or not). Users are responsible for reviewing and authorizing what AI Functionality does on their behalf, and for whatever a connected Third-Party Tool does, including costs it incurs.
- Billing terms now cover charges not tied to a subscription plan, such as AI Gateway credits, which can be charged at time of purchase or top-up. Vercel may bill accrued fees early if an account shows unusually high or suspicious usage.
- Enterprise customers who verify ownership of an email domain can now claim existing Vercel accounts using addresses on that domain; affected users are notified and can update their email, or the account may be added to the Enterprise team's account. Vercel says the Enterprise customer does not gain access to the account or its content without consent.
- Two new customer representations have been added: confirming the right to provide any third-party credentials or API keys given to Vercel, and confirming the user is not subject to applicable OFAC sanctions.
- Marketplace terms now define "Authorized Users," including Third-Party Tools; actions they take are bound to the customer, who is responsible for reporting unauthorized activity.
- The Privacy Policy's Data Privacy Framework section now designates VeraSafe as the private complaint handler for unresolved EU/UK/Swiss privacy complaints, which can be submitted to VeraSafe before escalation to a regulator.
