Introducing the Motion to Dismiss Workflow, Co-Developed With LexisNexisⓇ

Lawyers review ranked dismissal arguments before agents research U.S. law, check cases through Shepard's, and draft a court-specific motion.
Lawyers can upload a complaint to Harvey and work through a review-and-approve process to produce a researched first draft of a motion to dismiss. The new drafting workflow is the first co-developed with LexisNexis, using its U.S. primary law content and Shepard's® Citations Service.
Review the proposed arguments
A planning agent identifies the forum and governing law, then researches up to eight candidate grounds for dismissal. It checks those grounds against the claims pleaded, considers choice-of-law issues, and ranks each argument by strength with a short explanation. The lawyer can approve the strategy or request changes before deeper research begins.
Check the research
Research agents investigate each approved argument using jurisdiction-filtered searches. Each argument gets a memo with the applicable legal standard and three to five leading cases, including Bluebook citations, links to opinions in Lexis+, key holdings, and their application to the complaint. The memos also address weaknesses and adverse authority. Cases are validated through Shepard's Citations, with their Shepard’s Signals reported alongside them.
Draft for the relevant court
A drafting agent combines the approved arguments, complaint allegations, and retrieved authority into a motion. It uses the appropriate state-court procedure or, for federal complaints, the Rule 12(b)(6) standard and any other available threshold Rule 12(b) grounds.
The draft includes a Table of Contents, a Table of Authorities, and forum-specific formatting. Every factual assertion cites the complaint, and every legal proposition cites case law so the lawyer can check the draft against its sources.
Availability
Harvey says the workflow is available to customers with Ask LexisNexis access, and to Harvey customers who also subscribe to Lexis+ with Protégé, even without the Ask LexisNexis integration. A Motion for Summary Judgment workflow is next.
